What to Do After a Suspected Drunk Driving Crash
Immediate safety and medical needs come first. Evidence gathered soon after the collision may also become important to an insurance claim or civil lawsuit.
When your condition and the scene allow, take these steps:
- Call 911. Request emergency assistance and report the collision to law enforcement.
- Gather information safely. Obtain driver and insurance details and preserve available information about the vehicles and scene without trying to determine fault yourself.
- Seek prompt medical care. Emergency treatment and follow-up care create timely records of your injuries, symptoms, and treatment.
- Preserve relevant records. Keep medical bills, rehabilitation records, repair documents, wage information, and crash-related correspondence together.
- Use caution with statements. Be accurate, avoid speculation, and remember that insurers may examine what you say about the collision and your injuries.
We offer confidential consultations by phone or in person at no charge and with no obligation to pursue a claim.
How Civil Claims Differ from Criminal DUI Cases
The government controls a criminal DUI prosecution, while an injured person brings a civil claim for compensation. A civil claim may proceed whether the other driver was charged, acquitted, convicted, or never arrested because the evidence and legal standards aren’t identical.
NRS 484C.110 prohibits driving or being in actual physical control of a vehicle on a public highway or premises open to the public while impaired. The statute includes driving with a blood alcohol concentration of 0.08% or higher. When the offense that caused an injury results in a conviction, section 41.133 of the Nevada Revised Statutes makes that conviction conclusive evidence of the facts necessary to impose civil liability in the related case.
Claims Involving Alcohol Providers
Nevada law sharply limits claims against people or businesses that provide alcohol. Section 41.1305 of the Nevada Revised Statutes generally shields someone who serves alcohol to a person age 21 or older from civil liability for that person’s resulting conduct.
The law creates a narrow exception when someone knowingly serves alcohol to a minor or knowingly allows a minor to consume alcohol on property under that person’s control. Licensed servers acting within the course of their business are excluded from that exception. Whether the provision applies depends on evidence about the person served, the provider, and the circumstances.
Compensation & Insurance After a Drunk Driving Accident
Depending on the facts and Nevada law, we may seek compensation for:
- Medical bills
- Rehabilitation bills
- Lost income
- Pain and suffering
- Punitive damages when supported by the evidence
Economic damages address measurable financial losses, including treatment costs, lost earnings, and property damage. Non-economic damages address personal harms such as pain and suffering.
Punitive damages serve a different purpose from compensation for financial and personal losses. NRS 42.010 permits them when a driver causes injury while violating specified Nevada DUI laws after willfully consuming or using alcohol or another substance. The general cap in NRS 42.005 doesn’t apply to the DUI-based claims identified in NRS 42.010, but eligibility still depends on the evidence and applicable statute.
Available Auto Insurance Coverage
NRS 485.3091 sets Nevada’s minimum automobile liability limits at $25,000 for bodily injury to one person, $50,000 for bodily injury per accident, and $20,000 for property damage. Those limits may be insufficient after a collision involving serious injuries.
Uninsured and underinsured motorist coverage may provide another source of recovery when the responsible driver has no liability insurance or insufficient coverage. Its relevance depends on the injured person’s policy, available limits, exclusions, and documented losses. No category or amount of compensation is available in every case.
Nevada Rules for Filing, Fault & Fatal Crashes
NRS 11.190 generally sets a two-year filing period for Nevada personal injury claims arising from a crash. Other facts can affect how that period applies, so this general rule shouldn’t be treated as an assessment of an individual deadline.
NRS 41.141 establishes Nevada’s modified comparative negligence rule, which assigns each party a percentage of fault. A claimant whose share is 50% or less can recover damages, although the award is reduced by that percentage.
When a drunk driving crash is fatal, section 41.085 of the Nevada Revised Statutes allows the deceased person’s heirs to seek damages that may include grief, loss of probable support, and loss of companionship. The personal representative may pursue the deceased person’s medical and funeral expenses, as well as punitive damages the deceased could have recovered if they had survived. The proper claimants and available damages depend on the family relationship and circumstances.
